1. Purpose & scope
These terms and conditions of sale (T&Cs) govern all the services offered by SARL Chacam (Le 3ème Cercle and L'École du 3ème Cercle):
- event and culinary services on quotation (workshops, team building, seminars, receptions, dinners, private hire of the venue), aimed primarily at professionals (see Part A);
- online bookings and purchases (cooking classes, dinners with the chef, gift cards and vouchers), aimed at individuals (see Part B).
They apply to every order, save for specific conditions agreed in writing and stated on the quote. Placing an order or confirming a booking implies full acceptance of these T&Cs.
2. Prices
For services on quotation, the prices shown on the website are given for guidance only and have no contractual value: only the prices stated on the accepted quote are binding. For online bookings and purchases, the applicable price is the one displayed inclusive of all taxes (incl. VAT) at the time the order is confirmed. Prices are expressed in euros and include VAT at the applicable rate (20% unless a specific rate applies to certain services).
Part A: Services on quotation (companies & events)
3. Quotes & formation of the contract
Every service is the subject of a named quote, free of charge and without commitment, drawn up from the needs expressed by the client (date, number of participants, package, options). The quote details the services, the prices and its period of validity. The contract is deemed formed upon receipt of the accepted quote (dated and signed, or accepted electronically) and payment of the deposit.
4. Deposit, payment & late payment
The order gives rise to the payment of a 50% deposit of the total amount incl. VAT (unless a different amount is stated on the quote), the balance being due at the latest on the day of the service, unless a payment schedule is provided for in the quote. Payments are made by bank transfer. For professional clients, any late payment automatically triggers penalties at the legal interest rate plus the applicable increase, as well as a fixed recovery indemnity of €40 (articles L.441-10 and D.441-5 of the French Commercial Code).
5. Number of participants
The final number of participants must be confirmed no later than 3 business days before the date of the service; it serves as the basis for invoicing and cannot be revised downwards within that period. Any change request (menu, schedule, options) must be made in writing and remains subject to feasibility and to a possible price adjustment.
6. Cancellation of a service on quotation
Any cancellation or postponement must be notified in writing. Unless specific conditions are stated on the quote, the following scale applies to a cancellation by the client, depending on the notice given before the date of the service:
- More than 30 days: the deposit paid remains with Le 3ème Cercle;
- 30 to 15 days: 50% of the total amount incl. VAT;
- 14 to 7 days: 75% of the total amount incl. VAT;
- Less than 7 days: 100% of the total amount incl. VAT.
In the event of cancellation by Le 3ème Cercle (other than force majeure), the sums paid are refunded in full, to the exclusion of any other compensation.
Part B: Online bookings & purchases (individuals)
7. Online ordering & payment
Booking a class or a dinner takes place online: the chosen places are held for a few minutes, the time needed to complete payment. Payment is immediate and secured by bank card via our payment provider Stripe. The order is confirmed by a summary e-mail; the places are definitively allocated once payment has been collected. In the absence of payment, the booking is automatically released. Bookings for a cooking class are limited to 5 places per user; for a booking of 6 places or more, your request will require a personalised quote: please contact us at contact@cours-de-cuisine-paris.fr.
8. Gift cards & vouchers
Gift cards and vouchers are valid for one year from their date of purchase and can be used on the classes (individuals) and dinners offered by the School. They are transferable, materialised by a code, not exchangeable for cash and non-refundable. A partially used amount remains available on the card until it is used up or expires. If you lose the code, contact us at contact@cours-de-cuisine-paris.fr.
9. Right of withdrawal
In accordance with article L.221-28 12° of the French Consumer Code, the 14-day right of withdrawal does not apply to leisure services (classes, workshops, dinners) provided on a specific date or period: a booking for a specific date is therefore firm as soon as it is confirmed.
10. Cancellation or postponement by the client (classes & dinners)
Any cancellation or postponement request must be sent to us in writing. As a guide: a postponement is possible up to 7 business days before the date of the class, subject to available places; beyond that deadline, the place remains due. The client may make a new booking within a maximum of 3 months from the date the class was cancelled, provided that the initial validity date of the gift voucher used is at least 3 months away (a maximum of 2 postponements is possible). A client who cannot attend may freely transfer their place to another person, provided they let us know beforehand.
11. Cancellation by the School
A class may be cancelled if the minimum number of participants is not reached, or in the event of force majeure. The client is informed as soon as possible and is offered, at their choice, a postponement, a credit (in the form of a gift card) or a full refund of the sums paid, to the exclusion of any other compensation.
Common provisions
12. Allergies, dietary requirements & food safety
The client undertakes to communicate, upon confirmation or booking, all allergies, intolerances and dietary requirements of the participants. Failing information provided in good time, Le 3ème Cercle cannot be held liable. Our services are carried out in compliance with the applicable hygiene rules.
13. Client obligations & conduct of the event
Participants undertake to respect the premises, the equipment and the chef's safety instructions, to wear suitable clothing and to arrive on time: no lateness may give rise to an extension or a refund. The client is responsible for damage caused by participants under their responsibility. Minors may take part under the following conditions: 16 years of age minimum and accompanied by an adult.
14. Liability & insurance
Le 3ème Cercle is bound by a best-efforts obligation in the performance of its services and declares that it is insured for professional civil liability. It cannot be held liable in the event of a breach by the client of its own obligations, nor for indirect damage.
15. Force majeure
Le 3ème Cercle cannot be held liable for non-performance due to an event of force majeure within the meaning of article 1218 of the French Civil Code. The parties will then endeavour to agree on a postponement of the service.
16. Image rights & intellectual property
Photographs or videos may be taken during the services; their use by Le 3ème Cercle for communication purposes is subject to the agreement of the persons concerned. The recipes, materials and content provided remain the property of Le 3ème Cercle and are reserved for personal use.
17. Personal data
The data collected in connection with the order or booking is processed in accordance with our privacy policy.
18. Complaints
Any complaint may be sent to yl@3ecercle.fr for companies and to contact@cours-de-cuisine-paris.fr for classes for individuals. In accordance with articles L.612-1 et seq. of the French Consumer Code, a consumer client (individual) has the right, after a prior written approach has remained unsuccessful, to have free recourse to a consumer mediator.
19. Governing law & disputes
These T&Cs are governed by French law. Failing an amicable resolution, any dispute will be brought before the competent French courts; a consumer may in particular bring the matter before the courts of their place of residence.
